Notification of Copyright Infringement

TripGala operates in compliance with 17 U.S.C. § 512 and the DMCA. It is our policy to respond promptly to any notices of alleged copyright infringement and take appropriate actions as required by the DMCA and other applicable laws.

If you believe that your copyrighted material has been posted on TripGala without authorization or links to your copyrighted material appear in our search results, please provide us with a written notification that includes the following information:

1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.

Please note that if you knowingly misrepresent that material or activity on TripGala is infringing your copyright, you may be held liable for damages, including costs and attorneys’ fees, incurred by TripGala or the alleged infringer.

Counter-Notification

If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to TripGala’s designated copyright agent. Your counter-notification must include:

1. Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled.
2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
3. Your name, address, telephone number, and email address.
4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the federal district courts located in [City, State] if your address is outside the United States), and that you will accept service of process from the person who provided the original notification.
5. Your electronic or physical signature.

Please be aware that we may forward any valid counter-notification to the party who submitted the original copyright infringement notice. If we do not receive notice within 10 business days that the original notifier is seeking a court order to prevent further infringement of the material at issue, we may replace or cease disabling access to the material that was removed.

Repeat Infringers

TripGala reserves the right, in its sole discretion, to terminate the accounts of users who are found to be repeat infringers.
